Term’s and Condition’s Outrides

Mc Max makes use of a number of venues in and around the Johannesburg area that appear on this website. When you purchase an Outride from Mc Max you become legally bound by these venues’ terms and conditions. Please do not proceed and purchase an Outride or complete a booking until you have read, understood and accepted these terms and conditions. Mc Max will endeavour to have these terms and conditions on our website.

1. Prices
The prices displayed on our website are correct to the best of our knowledge and maintained on a daily basis. Prices of Outrides or bookings may vary throughout the year. In the event of an order being placed against an accidental incorrect price, we will endeavour to inform the purchaser of the error within 7 days of the purchase being made, we will allow the purchaser to either cancel the booking or choose to pay the additional difference in price.

2. Duration
Where the duration of an Outride is mentioned on our website and marketing material or by a member of our staff this is an approximate guide to the length of time you should expect to spend at the venue. The duration may vary slightly from venue to venue. When you are taking the Outride or booking as part of a group there may be some waiting time involved. Where possible we will outline the time spent at the venue separately to the time spent on the experience itself, although this is not always possible.

3. Descriptions and Images
All descriptions contained on our website and in our marketing, material is correct at the time of going to press. However, please note that descriptions are generalised as we offer similar activities and experiences across different venues which may vary in content across different locations. Descriptions may be updated throughout the year as venues change. The images used in all promotional literature to illustrate outrides and experiences, particularly those that take place at more than one location, are used as an indication only.

4. Availability
All outrides are offered subject to the availability of dates, vehicles, facilities and staff. Bookings should be made as far in advance as possible especially during peak times such as weekends and school holidays. We suggest that if you plan to make a booking for a date at short notice, you contact us to ensure there is still availability before completing the transaction.

5. Restrictions
Certain Outrides provided are subject to minimum age, or other requirements. In most cases, these details are listed on our website and at the time of booking, although they are subject to change at any time. It is the purchaser’s responsibility to check that the restrictions are met. Once you have confirmed a booking you are not eligible for a refund if you are forced to cancel because the minimum requirements are not met. Details of restrictions and requirements are set out on our website. Please read them carefully.

6. Weather
All our outrides we offer are weather dependent. If bad weather affects a booking it will be rescheduled by Mc Max at no cost to you and there will be no refunds. There can be no guarantee that a particular date will not be withdrawn due to adverse weather conditions. We strongly recommend that you contact us on the day before you depart for your Outride. In the event of cancellation, Mc Max will not be held liable for the cost of lost insurance premiums, travel expenses, pre-booked accommodation costs or any other costs incurred.

7. Safety
With all our Outrides a safety briefing is required and it is essential that the participant attends the briefing otherwise they will not be able to participate. Each person will also be required to demonstrate a certain level of competence on the scooter before proceeding on an Outride.
No alcohol or drugs can be consumed before any of the outrides or experiences we offer. The staff at Mc Max reserve the right to refuse an activity to persons suspected to be under the influence of alcohol and / or drugs.
All our outrides require the wearing of safety equipment such as a helmet (provided by Mc Max – You can also bring your own) this is mandatory and there are no exceptions. Other safety precautions will be advised during your safety briefing.

8. Mc Max Venues and Liability
Although Mc Max has sought to select the best possible venues to do the rides Mc Max shall not be responsible for the safety standards or the quality or delivery of the venues, or any loss or damage suffered by you whilst participating in the outride.
By purchasing an Outride, you acknowledge that the Outride or venue is dependent on certain factors beyond the control of Mc Max and agree that neither Mc Max nor any associated Venue management shall be liable for the cancellation, postponement or alteration of any Outride for reasons beyond its reasonable control including weather-related reasons, mechanical failure or otherwise.
Mc Max will endeavour to ensure a safe environment of the venues but do not undertake any examination of venues in order to minimise personal risk. In the event of unsuitable or unsafe conditions at a venue you should expect reasonable substitutions without notice
The total liability of McMax for any claim whatsoever in connection with the venue shall be limited to the price paid for the Outride. McMax will continually try and add new venues for the outrides. However, the use of the venues for the Mc Max Outrides is solely dependent on the management of each venue.

9. Refunds and Cancellations
In the event of an Outride cancelled or postponed for reasons beyond our control, such as the weather or mechanical breakdown, or for any reasonable reason beyond our control, in these circumstances, Mc Max is unable to reimburse travel, accommodation or any other expenses you may incur in relation to the cancelled outride or experience. An Outride may be terminated without warning on these occasions an equivalent or alternative venue and date will be offered. If this is not suitable a refund will be made to participants. All refunds will be made to the person who purchased the Outride and the monies will be refunded directly via the payment method used.

10. Complaints/Compliments
If a problem is encountered during an Outride please bring it to the attention of Mc Max staff, enabling us the chance to resolve the issue on the day. Mc Max undertakes to thoroughly investigate all customer complaints that have been highlighted on the day of the Outride, failure to highlight issues on the day of the Outride may jeopardise investigations and result in an unsatisfactory outcome.

Mc Max will greatly appreciate any comments from riders with regards their experience.

11. Bookings
Individual or Small Group Bookings. All bookings must be activated online at mcmax.co.za. Please do not arrive at a venue expecting to participate in an Outride. Mc Max management will have the sole discretion to allow a person to partake in a ride without a valid booking.
